Drainage Easement Access

Hi everyone! Sam Weiss here. I am a member of the HOA board and in this post, I am speaking for the board.
Recently there have been residents from Deer Trail II and from the neighborhood next door accessing the wet basin, dry basin, and drainage areas behind or between homes. I just wanted to reach out to help clarify some things based on communication that the board has had with county officials.
Here is a map of our neighborhood with all of the drainage easements shown in green. All drainage easements are located on private property with the exception of the under-road culverts, the dry basin, and the wet basin.
Anyone accessing these drainage easements between or behind residents’ homes is on private property and should seek permission first. If a resident has indicated with signage, fencing, or purple posts that they don’t want people to access their private property and someone does, then the resident (property owner) has the legal right to press trespassing charges (Disclaimer: I am not a lawyer and am not providing legal advice ).
With respect to the dry basin and wet basin. If you look at the map you can see that there is NO PUBLIC ACCESS to either. There are access easements for maintenance but not for the public. Additionally, any use of ATVs in these areas is clearly prohibited in the neighborhood restrictions.
